Terms of Use

The terms for using Investing and Retirement: what we are, how quote requests work, consent to calls and texts, acceptable use and governing law.

What these terms cover

These are the terms for using investingandretirement.com and every address that ends in .investingandretirement.com, including the quote and offer pages and our senior care section. They are published by Investing and Retirement Media LLC, a Delaware limited liability company, and they cover asking for quotes or offers through the site.

These terms and our Privacy Policy are one agreement. The Privacy Policy explains what we collect and who receives it. It applies to everyone who uses the site, and it is part of these terms for any request you submit, but you do not have to agree to it to read the site. By using the site you agree to the rules in these terms for using it, and you accept these terms again each time you submit a request to us. When a form puts wording next to a button or a box you tick, pressing the button or ticking the box is your agreement to that wording, and that wording applies to that request. If you do not agree, please do not use the site or submit a request.

What the site is and is not

We publish reviews, guides, calculators and comparisons. It is information, not personal financial, tax, legal or insurance advice. We are a publisher: we do not issue insurance policies, hold deposits, make loans, set prices or approve applications. Those decisions belong to the companies you deal with. We are not an insurer, an insurance agent or broker, a bank, a lender, a registered investment advisor or a financial planner.

Who can use the site

Anyone can read the site. It is written for people in the United States. To ask for a quote or an offer, or to agree to be contacted, you must be at least 18, live in the United States and be able to enter a binding agreement. The site is not meant for children under 13.

Rates, offers and estimates

Rates, fees, bonuses, coverage and eligibility change often and differ by person and place. A quote is an estimate. It is not a policy, and it is not an offer of credit. Nothing is approved, bound or in force until the company confirms it to you through its own process. Confirm the details with the company before you apply. Our Disclosures page has more.

Asking for quotes or offers

When you submit a request, you ask us to send the details you give us, and technical details about your visit such as the device and network you used, to the companies, agents and other providers that can respond to it. That can include companies you did not pick. They may use your details to prepare a quote or an offer and to contact you by phone, text message and email.

A request is an inquiry, not an application. We do not promise that any company will respond, that you will get a quote, or that you will be approved. Once a company has your details, it keeps and uses them under its own terms and privacy policy, not ours. Give only information that is accurate and yours to give. Some forms may fill in parts of your request from information that a third-party data provider holds about the person using your device. That information can be wrong or belong to someone else, so check every detail before you submit.

TCPA Consent: Calls and Text Messages

You expressly consent to receiving calls and messages, including auto-dialed and pre-recorded message calls, and SMS messages (including text messages), from the insurance companies, agents and other companies we work with, and from others calling at their request or on their behalf, at any telephone numbers that you have provided or may provide in the future (including any cellular telephone numbers). Your cellular or mobile telephone provider will charge you according to the type of plan you carry.

You give this consent when you give a phone number with a request for quotes or offers, or press a button or tick a box next to wording that asks for it. These calls and messages come from those companies, or from others calling for them, and not from us. Agreeing to calls and texts is not a condition of using this site or of buying anything. You can withdraw your consent at any time, in any reasonable way: reply STOP to a text message, tell the caller to stop calling, or email Help@investingandretirement.com or write to us at the address below. We do not make these calls or send these texts, so we cannot stop them ourselves. Replying STOP or telling the caller is the surest and quickest way. Message and data rates may apply to texts. TCPA is short for the Telephone Consumer Protection Act, the federal law on calls and texts.

Electronic communications and signatures

You agree that we may give you notices, disclosures and other records electronically, by email or by posting them on the site, and that the companies we work with may do the same, by email, on their own sites or by text message. When you click a button to submit a request or to accept something, or tick a box to agree to wording, that click is your electronic signature on it. You can ask for a paper copy of a record we have sent you, or withdraw your agreement to receive records electronically, by emailing us or writing to us at the address below.

Acceptable use

Our content and other companies' sites

The text, ratings, data compilations, code and design on this site belong to us or to the people who license them to us. You may read it, link to it and quote short passages with credit. A company's logo or name beside an offer does not mean it endorses us or that we endorse it. A link, a logo or an offer panel is not, by itself, an endorsement. Our own opinions are in our reviews and ratings. The site links to companies and sites we do not run, and their terms and privacy policies apply once you are there.

Disclaimers and liability

The site and everything on it are provided "as is" and "as available", without warranties of any kind, to the fullest extent the law allows. To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages. That includes lost profits, lost savings, lost data and lost opportunity that arise from or relate to the site, from relying on anything on it, or from your dealings with any company you find through it, even if we were told they were possible. This also protects our owners, officers, employees and contractors. The companies you deal with, not we, quote, lend, insure, call and text, and we are not responsible for what they do or fail to do.

Changes to these terms

We may update these terms. The terms that apply when you use the site are the ones in effect at that time. For a request, the wording shown next to the button you press applies to that request, even if these terms change later. A change applies to your use of the site from the date we post it. It does not change the wording you saw when you submitted an earlier request.

Governing law and courts

Delaware law governs these terms, without regard to its conflict-of-laws rules. Any claim or dispute between you and us about the site or these terms is to be brought in the state or federal courts located in Delaware, except where the law of your state gives you a right to bring the claim elsewhere that cannot be waived. If you use the site as a consumer, you keep any rights you have under the laws of your own state that cannot be waived by agreement.
